It applies to ORC day-use activities including disc golf, trails, biking, RC, drone use, day camps, field games, parking, spectating, and general site use.
You must declare whether this booking includes anyone under 19. If it does, complete the Minor Participant Consent & Acknowledgement of Risk section in this same form before checkout.
Activities Covered
This agreement applies to all participation at Okanagan Recreation Center, including disc golf, hiking and trail use, biking and e-bike riding, RC vehicle use, drone activities, day camps or organized camp days, field games, informal recreation, walking, spectating, parking, and general site use.
Assumption of Risks
I understand that participation at ORC involves inherent risks, dangers, and hazards. These may include uneven ground, changing terrain, slips, trips, falls, collisions, weather, wildlife, vehicle traffic, equipment failure, negligent acts of other participants, and the possibility of serious injury, illness, permanent disability, property damage, or death.
Health and Ability to Participate
I confirm that I am physically and mentally able to participate, that I will follow posted rules and staff direction, and that I will stop participating if conditions become unsafe for me or others.
Release of Liability and Waiver of Claims
To the fullest extent permitted by law, I release and discharge Okanagan Recreation Center, its owners, operators, staff, volunteers, contractors, agents, affiliates, successors, and assigns from any and all liability, claims, demands, actions, damages, losses, costs, or expenses arising out of or related to my participation, presence on the property, or use of ORC facilities, whether caused by negligence or otherwise, except where such release is not permitted by law.
Indemnity
I agree to indemnify and hold harmless the released parties from any claims brought by or on behalf of me, my estate, or other parties arising from my participation or conduct at ORC.
Property Damage and Equipment Responsibility
I accept responsibility for my own property and equipment and for any damage I cause to ORC property, other people, or other equipment through my actions or misuse.
Medical Consent
If emergency medical care is considered advisable and I am unable to provide consent at the time, I authorize ORC to seek emergency assistance on my behalf. I understand that I remain responsible for any resulting medical or transport costs.
No Reliance, Severability, and Governing Law
I am not relying on any oral or written statement outside this agreement. If any part of this agreement is found unenforceable, the remaining provisions stay in effect. This agreement is governed by the laws of British Columbia.
Confirmation of Understanding
I understand this agreement, I understand that I am waiving substantial legal rights, and I agree to be bound by it voluntarily.
Most visitors only need a day pass.
